Jen Loomis joined J. J. Keller in 2021 on the Content & Consulting Services Transportation Team. As an Associate Editor, Jen edits a variety of products including the Transportation Safety Training Advisor, Driver Report, and Driver Training Awareness Program newsletters. She also provides regulatory support in the area of DOT drug and alcohol testing.  

Prior to joining J. J. Keller, Jen had a 17-year career as a high school English teacher. She has also worked as a freelance proofreader and editor. 

Jen earned a B.A. in philosophy with a minor in business administration from Mount Mary College, a secondary English teaching certification from UW – Green Bay, and a master’s degree in English from UW – Oshkosh.

ANSWER:
According to §392.4, a driver cannot use a Schedule I drug. Marijuana is Schedule I and is prohibited even if the driver is legally prescribed it. In addition, use of a Schedule I drug medically disqualifies a driver based on §391.41(b)(12). There are no exceptions.
ANSWER:
Drug testing is not required when a non-CMV is involved in an accident, according to §382.303. If you do choose to drug test a driver after an accident, that test would be based on your company’s drug testing policy and state law. It would not be a DOT-mandated test
ANSWER:
Regulation §392.5 of the Federal Motor Carrier Safety Regulations prohibits drivers from possessing any alcohol except for that which is manifested and transported as part of a shipment. Alcohol is never allowed in the cab of the truck.
