FMCSA revokes its first ELD

For the first time, the FMCSA has removed an electronic logging device (ELD) from its list of registered devices.

The agency has authority to revoke its approval of ELDs that don't comply with the regulations. Many ELD providers have voluntarily removed their devices from the FMCSA's list of registered ELDs over the past few years, but the FMCSA has never taken action to remove a non-compliant ELD until now.

60-day deadline

On June 24, 2022, the FMCSA announced that motor carriers and drivers using the "ArionT" ELD (model AT5000) manufactured by Arion Tech Inc. must:

  • Stop using the device and revert to paper logs or logging software to record the required hours-of-service data; and
  • Replace the device with a compliant ELD by August 24, 2022.

The ArionT ELD appears on the FMCSA's Revoked Devices list, at eld.fmcsa.dot.gov/List/Revoked. Registered ELDs are found at eld.fmcsa.dot.gov/List.

Violation

Motor carriers and drivers who continue to use a revoked ELD after August 24 will be in violation of 49 CFR §395.8(a)(1), "No record of duty status," and drivers will be placed out of service, the FMCSA says.

The agency noted that the manufacturer of a revoked ELD can make fixes and have their ELD added back to the registered ELD list. The agency was tight-lipped about why the device was revoked.


Key to remember: The FMCSA has removed the ArionT ELD from its list of registered devices. Affected drivers have until August 24 to use another device.
